If you use that rationale you can justify anything- because "doing something you shouldn't be doing" is based on government definitions- it's not as if it's on a stone tablet handed down from God. So the government defines what we shouldn't be doing, and then can come after us without any constitutional protects- at least if you follow the logic in the sentence. It's a good thing most people understand that freedom is a bit more important. Rasmussen always seems to be an outlier. While it could be true that all the other polls are wrong, and Rasmussen is right, it's not very likely.
