When the "enemy" can be almost anyone (in terms of the collection methods you use), and is (possibly) to be found among your own citizens- then those rights do apply. I think most of us remember the Alien and Sedition Acts (reviled for a very good reason)- and we know the founders weren't morons- they understood this could happen. Where the "enemy" is imagined by the government to be in this country, the rights are our protection against the government's "imagination". I think we can see from Mr. Bush's rhetoric just how imaginative he can be.
