There is no need to enumerate what the government could do to the enemy.

Bush does my argument no good because he maintains and attitude that makes him the poster child for abuse but the principle is still valid, IMO. Those enumerated rights do not apply to dealings with the enemy.

I think most of us remember the Alien and Sedition Acts (reviled for a very good reason)

We're not talking about deporting or incarcerating anyone, just snooping.
