It's not a question of not WANTING them protected. It's that it's not feasible to protect them with a warrant. How would you do that? How would you get a warrant for that kind of data mining? Remember that in step one you are sifting through anonymous bits of messages fishing for key words or other markers using a computer. That process is incompatible with the warranting process. I'm prepared to back off on warrants not being feasible if you can show me how they could possibly work.

If the above is correct and step one and warrants are incompatible, then you have two choices. You can do step one without a warrant or you could simply put step one off limits, in which case doing step two for any leads you might have gotten from step one becomes moot. I assume you would put step one off limits and not develop leads that way. Is that correct?
