I don't, and you don't, and therein lies the problem- and one that can't be fixed.

I think it's essential to recognize that we can put all the checks and balances in place we want but that this an any president can abuse them with impunity as long as he can keep the violations secret. If they don't get a warrant, chances are no one will ever know. If they don't discard the innocent person's file, chances are no one will ever know. There is no mechanism such as warrants or impeachment that can stop them if they are determined to bypass the mechanisms.

After all is said and done and reasonable precautions are taken, we have to rely on the good will and ethics of the participants. The more they get harangued unreasonably and feel under siege, the greater their instinct is to go further underground, to get sneakier, which only lessens the chances than any violations will come to light. Our only recourse is to try to maintain good will by operating objectively and honestly to put a system of precautions in place and avoid chipping away at their good will in a futile effort to enforce what is at best faint protection.

As for the precaution on the table, the risk is small, I think. They simply have better things to do than harass targets that they discover are innocent. They have too much to do and bigger fish to fry. There's no incentive. That's not to say it couldn't happen, only that it would be an unlikely anomaly.
