It will be decided by human beings making a judgement call that will come as close to their personal views as possible. It should be and quite possible will be decided by people looking at the constitution. To the extent that personal views are involved they should be, and as far as I can tell in Alito's case they would be, personal views on how to interpret the constitution. It was only recently (1985) that Alito cited membership to a Princeton Alumni club which raison d'etre was to resist admission of women and minorities. That isn't an accurate statement. Even Republican Senator Lindsy Graham, a strong supporter, said "And I hope you'll understand if any of us come before a court and we can't remember Abramoff, you'll tend to believe us." I don't think it unusual that someone might sign up for some group and not really remember much about it decades later if they where never really involved in the group. Apparently Alito was not involved in the group, or at least not to any great extent. People in the group at the time now say they didn't even know he was in the group until it became an issue in the hearings. Tim
