I had not heard or any problems with the retroactive warrant, either, so that's why I posted this one. What is the flaw in his argument?

Even if they could come up with a good hypothetical situation, all they would have to do is amend FISA.

Well, of course. Did he suggest otherwise?

Of course, if they did change the law so that it read 72 hours after translation rather than capture, the administration could easily fudge the translation dates so that retroactive warrants could be attained at any time. You wouldn't like that, would you?
