ACLU Files Suit to Prevent America From Winning War
By Mark Noonan at 03:31 PM

If they win, I wonder if they'll sue to have the result of World War Two reversed on appeal?

NEW YORK - Federal lawsuits were filed Tuesday seeking to halt President Bush's domestic eavesdropping program, calling it an "illegal and unconstitutional program" of electronic eavesdropping on American citizens. The lawsuits accusing Bush of exceeding his constitutional powers were filed in federal court in New York by the Center for Constitutional Rights and in Detroit by the American Civil Liberties Union.
In a way, I guess this is useful - the courts will, in the by and by, rule that the NSA program was entirely legal, as they have many times in the past in similar circumstances. The presumption, of course, is that the suits were filed where they were because the ACLU believes that the judges in question will be friendly to their case...so, I expect there will be some well-publicised judicial rulings against the program, only to be overturned by appellate courts which will, you know, rule upon the law rather than upon leftwing conspiracy theories.

Still, I think this might be the first time a federal lawsuit was filed against the Commander in Chief's Constitutional authority to wage war upon America's armed enemies. Strange world we live in.
