The ACLU suit will be the linchpin in this issue - if they get a court ruling that Bush went too far, the political consequences will be far-reaching. It's one thing for Bush to blow off Congress and decide when to ignore the Constitution, but I doubt Bush would stand up and defy federal court rulings.

At least I hope not. If this administration disintegrates into Nixonian chaos, almost anything is possible in the name of "national security".
