that is exactly the problem that I am not sure if anyone got the answer.

I think typcially lenders and institutions are buyers of credit protection and hedgies sellers.

Say if Ramsey Su decides to start a hedge fund tomorrow, would I be allowed to sell credit protection? Who would determine that I have adequate reserves or resources to cover this protection? What penalty do I face if my bets go against me and I simply close up shop?
