The difference is where the nose is. I consider being subjected to smoke an assault. The government should protect us from assaults upon our person- and smoke actually invades our bodies.

I don't want the government interfering in areas where people are basically killing themselves, by themselves- for example smoke at home, drink at home (or in bars if you aren't driving)- but once you physically touch someone else because of your habit (whether you are polluting their air, or whacking them with your car), the government has a legitimate interested in regulating the offensive behavior- because it IS affirmatively touching someone else.

It's a good quote, but I don't think a smoker has any right applying it to smoking.
