Hamas is on the State Department's list of terrorists organizations, (along with dozens of other organizations)... but I don't think that is the equivalent of a Congressional Declaration of War. (Most at State regard Hamas as primarilarly focused on the Israeli/Palestinian conflict... not on anything outside the region.)

"It's not a crime to kill them."

Now THAT surely depends on where you are, and who you want to kill. (I doubt that killing any women or children that may have signed up for Party membership, or who are involved in political affairs [like running for office] or in their equivalent of soup kitchens, is likely to come with a 'get out of jail free card' anywhere.)
