Your mistake is thinking that just because the owner and salaried man are subject to the same law that the outcome is fair.

As I mentioned earlier, due process and equal treatment are what our system uses as a reasonable proxy for objective fairness, which is a figment. I can't think of any better framework for fairness. If you can articulate a better (fairer and at least equally workable) framework, I'd love to find out about it.
