I was talking more about the votes (or likely votes in Alito's case) than the style of the hearings. But than most of what I said could also be applied to the hearings as well.

I don't really remember Scalia's hearings well, but he did get a 98 to 0 vote despite being one of most conservative justices (Thomas is even more of an originalist and so arguably even more conservative), and the fact that Reagan didn't do a lot of consultation with the Dems before the nomination.

My point is that it is at most a modest factor, but I am not saying that it isn't a factor or that it is a very tiny one.

Also I think the trend is that things are going to get more difficult. Greater consultation might cause a positive deformation in the trend but not enough to break the trend IMO. I am commenting more on the trend than on specific singular nominees, any specific nominee mentioned was mentioned as an example of the trend.

I gather we are both saying it's a factor, perhaps disagreeing on the relative importance.

I think that is an accurate assessment.

Particularly in light of the very disturbing direction that court is now going.

That might be a point were we have a larger actual disagreement.

Although to be fair we haven't see any decisions effected by the new changes in the court and I might actually be disturbed.

Also I was disturbed by some recent decisions, although no more so than some other decisions which have been around for decades.
