I don't think so. Lock up a US citizen indefinitely without due process? The issue was about to go to the USSC and the Bush admin quickly had the case changed to a civilian court and charge (different, less onerous charge). They didn't want the USSC to rule on the case or they wouldn't be able to hold citizens without due process anymore.

Essentially, Bush is trying to circumvent the constitution and the rule of law in any way he can. Promoting Democracy abroad (result Hamas) while fighting it at home.
