Ok, did a little checking...if I have this right, Eurozone as a whole has an output limit of 104dB. All iPods ever shipped to Europe (and presumably the US) have had 104dB as their max output (assuming one uses Apple's earbuds). There was a kuffuffle with France a couple years back, because France has its own limit of 100dB. In any case, both 100 and 104 and much MUCH lower than the 115dB being cited in the article.

I doubt this lawsuit goes anywhere...
