"Until the specific case goes to court and gets decided by a court of law."
"A case like that wouldn't last past the first court. The judge would throw the case out. They are clearly legal here under pre-established law. The only decision the court would make would be to tell the plaintiffs to get lost."
You have your opinion but you don't know that.

Check with the legal eagles around here. There certainly are plenty.

"A good example of excessive gov't control of the press. And now even you recognize that."
Not really the point. The point is that people bring law suits and the perception that people have changes with time. As a result so does the way laws are used.

Over here it has been changing to make it increasingly difficult for gov't to stifle the press. The gov't attempted to prevent publication of the Pentagon Papers. It was told by the courts that the press could publich, THEN the gov't could bring whatever cases it thought appropriate. In fact it brought none. The contents were embarrassing for the gov't but they could not reasonably justify classification of the information.

" I notice that neither you noe others have had problems understanding my meaning." Because you refuse to accept that things are more complicated and are simpler than your take of them.
One thing we did learn over here that apparently some Europeans haven't is that if youlet the gov't stifle expression because of dangers it imagines, soon you will have no freedoms left. Is saying that the Eastern Europeans and Russians were particularly prone to anti-Jewish pogroms in the last and preceding centuries an insult to them that should be banned even though true? I can see where your gov't might answer "yes". Ours would have to answer "No". Truth is an absolute defense in almost all cases.

Tell the truth and let the chips fall where they may.
You never did answer: How many Hindu suicide bombers can you name? And how many Islamic? There's a truth for you to grapple with in relation to those cartoons.

"We were talking about Islam and Saudi claims to be the purest example."
No we were talking about Denmark, cartoons that demean a religion, and the reactions of those who practice that religion. You changed the subject to S.A.

SA serves as a beautiful example of Islam at its worst. Even most Islamic nations will not go to the extremes they adopt.
Now did I just violate Danish law by saying that? Tell your gov't it is free to try to extradit me. Mine will answer that it sees no crime.

"And you can bet any attempt by a state legislature to limit appeals to the federal courts is just going to generate more appeals to the federal courts. A state legislature CANNOT bar appeals to federal courts in this country."

I hope you understand how difficult it is to bring a case to the federal courts when that case is based on de facto discrimination. As opposed to clear cut discrimination cases.

You would not BELIEVE how often it has been done here. In fact, a showing of de facto segregation is often sufficient and bolsters your case in any event.

Here is an article that illustrates the problem.

THat case will not test freedom speech or the press or religion. It will test the right of doctors to perform a specific procedure. And the rights of parents to be informed of such. Western law- -all law- -has long recognized a diminished right of decision of minors. Minors, for example, can in most instances not form legal contracts.

You got any example that are actually on point?
