Like I said, though --- if you cause harm you should be responsible for the damages.

(Your example of smoking in a small, confined public space... thew the extent that pollution could be demonstrated to cause harm, and that degree of harm reasonably allocated, then presumably the owner/operator could wind-up on the hook for financial damages. A cleaner example of this responsibility though might be the heavy metal contamination of a drinking water supply watershed....)

Freedom is of the upmost importance... but it does not come without responsibility.
