Is Ted Kennedy the President or the VP? Was Ted ever put into a situation where he was required to exercise his "sense of judgement" on behalf of the country?

We are talking about a VP's sense of judgement. This is a VP who uses his judgement to advise the President on whether to pull the nuclear trigger or not.
