I imagine Will is persona non grata in the current Bush White House. He has taken it on himself to be the voice of old-school classic conservatism and savage the current "conservative" Congress and administration for straying so far off the reservation.

I would guess that he doesn't want to see anything that weakens a president's power to do the necessary when it comes to national security, but under Congressional oversight as stipulated in our governing documents.

The scary part is that the administration could easily defuse the issue by getting a revised FISA bill from Congress. Everyone would be happy.

So what else do they want to do (or are doing now) outside the Congressional purview that they don't want to implicitly criminalize by admitting that FISA has sway over wiretaps?

Makes me wonder.
