The concern expressed in the Constitution is in regards to the term 'unreasonable' searches. Most people have agreed that the idea of searching through communications with suspicion of foriegn terrorist origination or termination is reasonable. The question being posed is whether Bush violated some technical rule of law, not whether it is reasonable to perform such searches.
