Miers could never have gotten through the confirmation process. Her knowledge of legal precedent and theory was so weak that the word was out from Congress back to the White House that she could not make it through the hearings. She knew it. Most lawyers looking from the outside in knew it. As far as an acceptable candidate, regardless of politics, she was so far down the list as to be unidentifiable.

Bush felt he had the right to nominate anyone he wanted, as if a Supreme Court justice choice was a personal right rather than a duty to the Country.

Dead wrong, as was readily seen.
