Have you read the transcript, Tony's postings here, the memorandum of law filed by both sides as well as US. v Booker?
If not, you don't understand how this works too well. Tony was convicted of factually impossible acts, and under US v. Booker, sentencing guidelines are now only ONE of many factors the Judge is now MANDATED to consider before he imposes the sentence, among which is the UNDERLYING CONDUCT that surrounded the convictions.
For those convictions that were factually impossible, blame the lawyers, blame 9-11, blame his "high priced jury consultant" who may have picked a less than unbiased jury, blame the fact that he was brutally assaulted in jail DURING HIS TRIAL, Not because he was a stock manipulator but because he was a "rich terrorist," then held in isolation for weeks during his trial, unable to communicate by phone with ANYONE INCLUDING HIS LAWYER, coming to Court some days in so much pain that he was hardly able to function much less defend himself, blame Derrick Cleveland who clearly and without question lied time and time again on the record, and whose testimony was refuted by the government's own SEC witnesses and who admitted to being a liar, and yet is still being believed by the government in their quest to take so much of Elgindy's life; blame the fact that, while there were NO questions to the jury pool about 9-11, it was pervasive throughout the entire trial, and the government's only rebuttal witness was used for the exclusive purpose of using the name "ZACARIAS MOUSSAOUI"; blame the fact that an Arab-American was wrongfully accused of having pre-knowledge of 9-11 when there was no such evidence, and he was acquitted of that charge; blame a government that overcharged this case under the onerous RICO statute, the only way they legally were able to freeze his assets pre-conviction; and of course blame Tony himself for using exceedingly poor judgment at MacArthur airport, but DON'T EXPECT this Judge to blindly sentence this man without examining the entire record and package, and unless and until you have read the entire record, and the memorandum that are all available publicly on Pacer, your posts are unsupported by the knowledge required for anyone to take you seriously. |
