I don't think the law professors in question were too stupid to know what the law is. Dragging things out in court served several useful purposes -- gave the schools time to decide what they wanted to do, made a political statement.

We can predict in advance that the South Dakota law prohibiting abortions will have a similar fate but none of us expects South Dakota to fold its tent before they get all the way to a final decision.
