OT: Some words that some of you might be interested in regarding PLNI and Tortuous Interference. tor·tu·ous (tôrch-s) adj. 1. Having or marked by repeated turns or bends; winding or twisting: a tortuous road through the mountains. 2. Not straightforward; circuitous; devious: a tortuous plot; tortuous reasoning. 3. Highly involved; complex: tortuous legal procedures. Tortuous interference is the unlawful interference into one’s contractual or business affairs. For example, someone who uses the web to defame an individual’s business and contacts their customers, or prospective customers, may be violating this law. When such interference is an organized effort of three or more persons a civil conpiracy is formed. The three areas below seem to be applicable. INTERFERENCE WITH PROSPECTIVE ECONOMIC ADVANTAGE Generally speaking, there are five elements applicable to this particular tort. First, there must be an economic relationship containing the probability of future economic benefit. Secondly, there must be knowledge by the defendant third party of the existence of that relationship. Third, there must be intentional or negligent acts on the part of the defendant designed to disrupt the relationship. Fourth and Fifth, there must be actual disruption of the relationship and damages caused thereby. INTENTIONAL INTERFERENCE WITH THE RIGHT TO PURSUE A LAWFUL BUSINESS This claim is straightforward in that the elements are: (1) An intentional; (2) interference; with (3) a lawful business, calling, trade, or occupation. CIVIL CONSPIRACY The elements of a case for civil conspiracy are as follows: (1) the formation and operation of a conspiracy; (2) the wrongful act or acts done pursuant thereto; and (3) the damage resulting from such act or acts. The wrongful acts may be any civil wrongs; for existence, fraud or inducing breach of contract. A key litigation consideration is the availability of joint and several liability. The various message boards that are being filled with negative information about PLNI are Prima Facie indication of the three above crimes directed at PLNI. Whether PLNI decides to expend the investors funds to pursue the individuals involved is clearly up to them, but I believe that as long as these people hide behind the anti-SLAPP laws while conducting illegal activities American small business has a real problem. I am encouraged with the recent California decision on the Overstock.com vs Gradient/Rocker case that threw out the anti-SLAPP defense entirely. The time for Justice for these people is approaching. rrm
