The law was enacted to keep creeps like Nixon from spying on folks on his enemies list. There is nothing in the Constitution that allows wiretapping without a warrant.

The Constitution is based on a system of Checks and Balances which keep the president from wiretapping without judicial oversight.

He lied, because he said that he would get court approval for wiretaps...and then he didn't.

Bush lied. If it's legal to wiretap without a court order, and I believe it is not, that's outside this discussion. Bush said court orders would be obtained.

I argue that he lied about getting court orders for wiretapping. It's a separate issue about him breaking the law.
