He is confusing actions of individuals and government policy. In the first case, a judge will determine if the cop / FBI agent used proper judgement (warrantless searches are permitted if you are chasing a subject or believe there is an emergency). With a policy of warrantless searches, they are always illegal - all fruit of the poisoned tree will be tossed - and the US is less safe.
