I think it's very important to spread the word that those who manipulate with advance knowledge of material non-public information in order to bash may have some issues in the event there is an association in an Enterprise, including, but not limited to, trading ahead of the news. The law (and commentary) is evolving with respect to trading by associates and the breadth of this type of Enterprise. Bottom crawling blog dwellers aren't immune from issues involving non-public information.

We've recently seen a case of criminal prosecution and resulting conviction with respect to this type of "prediction" history, based on material, non-public information. Possible criminal prosecution exposes manipulators not just to civil damages, from which they can claim poverty in order to escape.

Obviously, assumptions are merely that and each case is judged by its own fact pattern. However, when someone predicts correctly material non-public information on a regular basis, perhaps regulators may assume that this is more than just a "prediction," for the purpose of conducting further investigation?
