The establishment clause:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.

Everson vs Board of Education established, amongst other things, that you cannot be forced to profess a belief or disbelief in any religion. Pledging that our nation is 'under God' seems to force atheists into believing in God.

Additionally, Engel vs Vitale prohibited school prayer as a state endorsement of religion. The 'under God' clause could be construed as a prayer by an atheist.

It would be interesting to see what the present SCOTUS would (will?) rule on this issue.
