Contrary to what people think, there is no legal status to being married. The only advantage to it is that is a good tax dodge. Its tax status is not even necessary as anyone can declare a dependent at any time without a marriage license or other paper.

You don't need a license to get married. That is all hooey. A tax on the stupid.

Gays wanting to be married just show that they don't understand it. It does not confer on anyone any rights whatsover. If someone won't issue them a marriage license, it really doesn't matter. No one has the authority to issue a permit to marry.

Divorce is a different issue, and the government has long interfered in that area. In fact since they did not legitimize marriage in any way, they had no business getting involved in divorce.
