Hold the phone. McDermott didn't tap any phones. Private citizens taped the conversations of Gingrich, in which he was plotting to deceive the American people. They then sent the tape to McDermott who was chair of the ethics committee.

Now you're the chair of the ethics committee, and a tape lands in your lap which clearly indicates that Gingrich is involved in wrong doing against the American people. What would you do? Sweep the crime under the carpet?

Bush on the other hand was actively breaking the law by authorizing illegal wire taps.

There's a big difference in these two cases.
