In our litiginous society, the "loss of chance" tort has probably "sold" more MRI's and cat scans than any real medical considerations. My understanding is that the probability of ameliorating the bad effects of a procedure doesn't really have to be very large, as long as it is finite. I.e., absent significant morbity, us docs can't plead that there was only a 10% chance of something helping, so it wasn't malpractice.

I.e., we have to give the patient a "chance". So, absent an equivalent or some other thing such as fear of infringing a patent, the transplant docs are going to have to offer Graftcyte. It may take them a while to figure this out, but these people are _very_ smart.
