I would expect a challenge under the fifth amendment and possibly the ninth. Amendment V: No person shall... be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. A government forcing a person to buy a private insurance policy that he doesn't want and may not derive any benefit from seems to be an infringement on liberty and property.
