Duke is not helping its case any more than Yale is helping its by stonewalling the admission of the Taliban Man. The university can waive protections for these students, but until it holds a disciplinary hearing, there is little that it can do to the students.

It helps to remember that this is the US where even scum bags are presumed innocent until proven guilty.
