Joe,

The whole area of "legal" liability for posting opinions on a discussion board designed for people to post opinions is very interesting.

To me, the answer is obvious. If a company is concerned about the potential for misinformation to be posted on a board and have an effect on the stock price, then they should have someone in their investor relations department actively participating in the board. This way, if someone else puts up a message that is stated as facts but really is not, the company representative could post a rebuttal. The readers of the board could see both statements and decide for themselves how much weight to give to each side.

Such an approach would go a long ways to increasing the value of these boards for the small investor. For example, if someone here posted a message stating that only 3% of NetWare 3.x customers had upgraded to NetWare 4.x, someone from the company could respond in a number of ways: saying from a minimum "That's not right, it's much more than that" all the way to saying something like "Our market studies indicate that 15% have upgraded, another 10% plan to in the next year, and only 8% have switched to NT". NOTE: these numbers are not even educated guesses, I have no idea what the real numbers are.

Companies and investors just have to adjust to the capabilities of the new media.

Jerry
