Since most products sold in a state probably came from another state, the interstate commerce trump card probably applies. Otherwise a state could mandate zero consumer protection in an effort to lower prices for its citizens. The "savings" would be made up theoretically in physical damage to consumers, but some politicians would say that's their business and their risk to run.

That's about as far as my "expertise" in constitutional law extends.
