Nope. In order to be sued for libel it must be proven that you knowingly stated a falsehood in an attempt to cause material loss to the person.

In this case the rape allegation is most likely believed by the person making the comment. Even if evidence comes forward someday proving the comment to be wrong, there would be no libel case because the statement was believed at the time it was made.
