I'm a lurker, and your post got me going on Qwest. Now I've got a couple of questions that I hope you or another member might be able to answer. First, is anyone besides Qwest selling "dark fiber?" In his Telecosm series article, "Into the Fibersphere," Gilder said (and this was more than 5 years ago) that the telcos were fighting the FCC in court to prevent the FCC from requiring that they sell dark fiber to corporate customers. My next question is whether that case was settled or not and what was the outcome? The case name is "Southwestern Bell et al v. the FCC and the U.S. Dept. of Justice." I've tried searching for it but haven't been able to come up with anything (maybe I don't know where to look).

I'm a huge Gilder fan, and I read the posts here daily. Hope one of you can help with this. Thanks.
