Like you pointed out, HIPAA was *very recently* enacted into law --- and some of it's provisions were thought to CONFLICT with OTHER laws that had long been on the books... for example, the rights of law enforcement to do their jobs. That is what the Court ruled on, and HIPAA was reined back.

(Like I've already said: PERSONALLY I would be VERY HAPPY to put a firm right to privacy in our US Constitution! How about YOU?)
