Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
That denies your first allegation. That makes NO exception for war. A search of a person or home in the United States requires at least probable cause. An officer arresting you can search you, but the arrest itself establishes probable cause of commission of a crime. This isn't something new at all; that amendment was ratified in 1791. |
