You cite Presidential power WITH RESPECT TO FOREIGN INTELLIGENCE!

The issue here IS NOT FOREIGN. The Presidential powers wrt foreign agents and powers is irrelevant; here we are talking about the right of the President to monitor in any way conversations between AMERICAN citizens, all of whom are located on AMERICAN soil. The Constitution makes NO exception for wartime in its requirement for a warrant in such a situation. It also does not say the President can order taps of AMERICAN citizens in a hunch some calls be to foreigners located on US soil.

You are discussing THE WRONG PROBLEM. I never argued the gov't did not have the legal right to tap foreign calls into the United States. In fact, I have said the exect opposite- -that he did have that power and such operations had been underway for decades.

YOUR problem is to show that the Prexy can order warrantless taps of domestic call between US citizens.

Go to it. This should be interesting.
