If the gov't gets into the content of a phone call originating and ending inside the US, it needs a search warrant. Period.

If the President is acting under his constitutional powers as commander in chief, authorized by the congression use of force that was passed 2001, then he does not.

There is no legal ruling on this denying the President to conduct Foreign Intelligence surveillance, EVEN if that surveillance deals with domestic internal calls, so long as they are connected to foreign intelligence activities.

However, in the case of law enforcement (organized criminal activities, then YES.. a warrant is required).

And were your position one of such legal clarity, this president would have been impeached last year.
