Expect improvements on this process over time, and then a huge leap at 45. If Intel has indeed furthered low-k for 45nm then it will virtually garantee a break through in reduced leakage. Yields however are a completely different matter. If this will play out (very low leakage at 45nm, at least somewhat low yields) then that would be as I've been expecting for a while now already.
