Churchill committee finds misconduct, but disagrees on punishment

DENVER - 9NEWS has learned recommendations made by members of the investigative committee looking into allegations of misconduct by tenured University of Colorado professor Ward Churchill vary from suspension to termination.

The committee submitted its 125-page report following a lengthy investigation. The report was released to the public shortly before noon Tuesday.

The report deals with whether or not Churchill engaged in research misconduct, specifically seven allegations including plagiarism and misrepresentation of facts.

Based on the investigation, the committee unanimously found Churchill committed several forms of academic misconduct as defined in the policy statements of the University of Colorad and Boulder and the University of Colorado system. The committee found that Churchill's misconduct was deliberate and not a matter of an occasional error, according to the report.

The committee also noted that Churchill was disrespectful of Indian oral traditions when dealing with the Mandan/Fort Clark smallpox epidemic of 1837, in both his essays and during the course of the investigation.

Two members of the committee say in the report Churchill should not be dismissed and the most appropriate discipline is suspension without pay for two years.

Three members think the violations are so serious that he falls under university criteria for dismissal. One believes he should be dismissed outright and the other two think the most appropriate discipline is suspension without pay for five years.

The recommendations and findings of the investigative committee were given to the university's standing committee last week. The standing committee will now make a recommendation to CU's Chancellor.

The standing committee will likely make its recommendation within a month.

Churchill has been a controversial figure at CU in recent years, beginning with remarks he wrote about victims of the 9/11 terrorist attacks, and also whether a questionable Indian ancestry affected his hiring.
