I already posted the news. Bush asked for the investigation. The FBI conducts the investigation for the justice department. Now when information is needed, like phone records, the FBI needs authorization to collect them. Otherwise the phone company is not supposed to give them to them. The options were, 1. get a court order, or 2. other lawful authorization.

Under the category of other we have the National Security Letter, authorized under the Patriot act. In this case, Bush authorized the the FBI to obtain phone records. He did so with an NSL. Or perhaps Cheney was able to sign for that one too. The law says the NSL has to come from the administration...and as we all know Cheney is part of that.
