Bush is doing a lot more than obtain phone records. He is doing what Nixon did times a hundred and on a much much high-tech scale. What has come out so far is probably the tip of the iceberg. Every political opponent of Bush-Cheney's is a probably target of their illegal bugging and surveillance.

Also, yes collecting phone numbers with a pen register of whatever is bugging and it requires a warrant.
