for AMD to require the future sale of X processors by Y time before agreeing to any public announcement?

Does DELL even need AMD's agreement for DELL to announce that they will sell AMD 8xx Opteron hardware? What is to keep DELL from buying the chips on the open market?

Let's assume DELL got no better price than does HPQ or SUNW. I imagine you don't get an OEM discount without some sort of "take or pay" minimum. But I don't know.
