My problem is if this is a public forum (Like being interviewed on TV etc) than a company can claim that one says negative things because he wanted to move the stock (If he was a a short) so there is malicious intent. But if it is a chat room, and that all of us sitting here are saying our opinions about a co. and we aren't trying to move the stock because that isn't our purpose then we shouldn't be sued since we would have constitutional protection.
I think a lot of people are focusing on this issue.
I think Silicon Investor is even more interesting because you have to pay to post. If I pay to go to a stadium with the right to scream out negative things is that a private event (we all paid to be here so that we could discuss issues and not move stocks) or do you say it is still public especially since anyone could read these posts.
To narrow the focus, If we pay membership to join a investors club and there are 100 members could we say don't buy that stock or it is a short just because we happen to be short it? Maybe disclosure is enough, I have an opinion about a stock and but let me forewarn you that I am short the stock. Is it still malicious intent or are you just explaining your opinion? (again I am not talking about our case here where someone might have said nasty things). The point is until the court takes this up there might be enough here to get you dragged into court for what we might consider a negative comment.
Finance chat rooms have lost its appeal and I don't think it is worth the risk to post.
