If it's a sure bet that the Plaintiff will win, and the ACLU will get paid, then the Defendant is clearly in the wrong.

Depends on what you define as "wrong," CB. And if the City involved is too chicken to go to court and would rather settle. In San Diego, as I recall, the ACLU collected on the Boy Scout's use of a city park.
