Actually, if you had bothered at all to read about this law suit, you would know that Sgt. Peter Damon was interviewed from his gurney by Brian Williams on NBC News. Moore acquired the clip, edited it, and portrayed Damon in an anti-Bush anti-war sequence in his film. Damon signed no permission document or waiver.

It seems to me he has a valid claim. But that will be up to the courts to decide.
